ichini! Terms of Service

1. Introduction
These Terms of Service ("Terms") govern your access to and use of the ichini! website, applications, APIs, and related services (collectively, the "Service") operated by Sebastian Bitzer ("Company", "we", "us"). By using any part of the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 16 years old (or the age of legal majority in your jurisdiction) to create an account. By registering you confirm that you meet this age requirement and are legally competent to enter into these Terms. If you are between 16 and 18 and local law requires parental consent for online services, you represent that such consent has been given. We do not knowingly permit individuals under 16 to register at this time.
3. Health & Safety Disclaimer / Assumption of Risk
ichini! is not a medical organisation and does not provide medical advice. All workout content is for informational purposes only. Consult a qualified healthcare professional before beginning any exercise program. Physical exercise involves inherent risks; by participating you assume full responsibility for any injuries or damages that may occur.
AI-generated content notice: Some workouts and workout plans are assembled automatically by an artificial-intelligence system using a curated library of exercises. While every exercise is vetted, the exact sequence is generated algorithmically and may contain errors or be unsuitable for your individual condition. You are responsible for using proper exercise form; improper technique can lead to injury. Always listen to your body and stop if you feel pain, dizziness, or discomfort.
4. Account Registration & Security
To access certain features, you must create an account and provide accurate, current information. You are responsible for keeping your credentials confidential and for all activity under your account.
5. Subscriptions, Fees & Payment
Paid features are offered via subscription processed by Stripe. Prices, billing periods, and features are displayed during checkout. You may cancel anytime; access continues until the end of the current cycle. Except where required by law, payments are non-refundable.
6. Consumer Rights (EU / UK)
If you are an EU or UK consumer, you have a statutory right of withdrawal for digital content not yet supplied. By starting a subscription and clicking Start Workout, you request immediate performance and acknowledge losing that right once access begins.
7. Licence & Acceptable Use
We grant you a limited, non-exclusive, revocable licence to access the Service for personal, non-commercial purposes. You must not copy, reverse-engineer, or misuse the Service, nor infringe any law or third- party rights.
8. User Content
8.1 Definition
“User Content” includes any content you upload, including videos of yourself performing workouts.
8.2 Licence for Public User Videos
If you mark a video as public ("Public User Video"), you grant Company a world-wide, perpetual, sub-licensable licence to host, display, edit, remix, and incorporate snippets into new workouts, including combinations with other users’ clips, for any purpose related to the Service.
8.3 Licence for Private User Videos
Videos kept private remain visible only to you; Company merely hosts them to provide the Service and will not remix or publicly display them without additional consent.
8.4 Moral Rights Waiver
To the extent permitted by law, you waive any moral rights in Public User Videos for the uses described above.
8.5 Representations & Warranties
You warrant that you own all rights necessary to grant these licences and that your User Content complies with laws.
8.6 Removal
You may delete User Content at any time. Deletion will also affect derivative works created under §8.2.
9. Intellectual Property
All intellectual-property rights in the Service (excluding User Content) belong to Company or its licensors. “ichini!” and related marks are Company trademarks.
10. Third-Party Services & Links
The Service may link to third-party sites (e.g., Stripe). We do not endorse and are not responsible for third-party services; your dealings are between you and the third party.
11. Termination
We may suspend or terminate your access at any time if you breach these Terms or pose risk to us or others. Upon termination, the licence in §7 ends and you must stop using the Service.
12. Disclaimer of Warranties
The Service is provided “as is” without warranties of any kind, including fitness for a particular purpose. We do not warrant that the Service will be uninterrupted or error-free.
13. Limitation of Liability
To the maximum extent permitted by law, Company shall not be liable for indirect or consequential damages. Where exclusions are not allowed, our liability is limited to the greater of (a) the amount you paid in the last 12 months or (b) €50.
14. Indemnification
You agree to indemnify and hold harmless Company and its affiliates from any claims arising out of your use of the Service, User Content, or breach of these Terms.
15. Governing Law & Dispute Resolution
These Terms are governed by the laws of Germany unless mandatory law in your country of residence applies. EU/UK consumers may bring disputes in their local courts. US residents agree to individual binding arbitration (no class actions) administered by the AAA.
16. Modifications to Terms
We may modify these Terms at any time. Material changes will be announced 30 days in advance. Continued use after the effective date constitutes acceptance.
17. Severability & Miscellaneous
If any provision is held invalid, the remainder stays in force. These Terms constitute the entire agreement between you and Company.
